1. Acceptance of Terms

By accessing, browsing, or using Venezuela Real Estate ("the Service," "we," "us," or "our"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must immediately discontinue use of the Service.

Your continued use of the Service following any modifications to these Terms constitutes acceptance of those changes. We recommend reviewing these Terms periodically.

2. Nature of Service - Information Only

Venezuela Real Estate is exclusively an information aggregation and translation service. We compile, translate, and present real estate listing information sourced from third-party Venezuelan websites and platforms. Our Service is designed solely to provide English-language access to publicly available real estate information.

We explicitly are NOT and do NOT operate as:

• A real estate brokerage, agency, or broker
• A real estate agent or salesperson
• A legal services provider or law firm
• A financial advisor or investment consultant
• A property valuation or appraisal service
• A transaction facilitator or escrow service
• A property management company
• A representative, agent, or fiduciary for any party

3. No Transaction Involvement - Complete Disclaimer

WE HAVE ABSOLUTELY NO INVOLVEMENT IN ANY REAL ESTATE TRANSACTION. This is a fundamental aspect of our Service that you must understand and accept:

• No Verification: We do not verify, validate, or authenticate any property listing, property details, ownership claims, seller identity, pricing accuracy, or any other information presented on our platform.
• No Representation: We do not represent, act on behalf of, or advocate for any buyer, seller, property owner, agent, or any other party in any capacity whatsoever.

All information provided on this Service is sourced from third-party platforms and is presented "as is" without any warranty of accuracy, completeness, timeliness, or reliability.

• Third-Party Sources: Listing information originates from external Venezuelan real estate websites. We have no control over the accuracy or currency of this source material.
• Translation Limitations: Our translations are provided for convenience only and may not perfectly convey the original meaning, legal terminology, or nuances of the source material.
• No Guarantees: We make no guarantees regarding property availability, pricing, features, conditions, legal status, or any other listing details.
• Outdated Information: Information may be outdated, incomplete, or incorrect at any time. Properties may be sold, prices may change, and details may be inaccurate.

6. Subscription Services and Payments

6.1 Access to the Service

All users, whether registered or not, have full access to property listings, including addresses, maps, directions, search, and listing alerts. We no longer offer a paid premium tier to new subscribers. A small number of existing subscribers maintain an active premium subscription for billing purposes; those subscriptions confer no additional access beyond what every user already receives.

6.2 Billing and Payment

Existing premium subscriptions are billed monthly through our payment processor, Stripe. If you are an existing subscriber, you authorize us to charge your payment method on a recurring monthly basis until you cancel.

6.3 Cancellation

Existing subscribers may cancel at any time through your account settings. Upon cancellation, you will retain your subscription until the end of your current billing period. Since all users already have full access to the Service, cancellation does not reduce any features available to you.

6.4 Refund Policy

All subscription fees are non-refundable. We do not provide refunds or credits for partial months, unused features, or dissatisfaction with information accuracy. You are paying for access to our information aggregation service, not for any guaranteed outcomes.

6.5 Price Changes

We reserve the right to modify subscription pricing at any time. Existing subscribers will be notified of price changes at least 30 days in advance.

7. User Accounts and Responsibilities

When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain the security and confidentiality of your login credentials
• Immediately notify us of any unauthorized access or security breaches
• Accept full responsibility for all activities under your account
• Not share, transfer, or sell your account access to others

Property listing images and descriptions originate from third-party sources and remain the property of their respective owners.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• WARRANTIES OF MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY, RELIABILITY, OR COMPLETENESS OF INFORMATION
• UNINTERRUPTED OR ERROR-FREE SERVICE
• SECURITY OF THE SERVICE

WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS, OR THAT ANY INFORMATION OBTAINED WILL BE ACCURATE OR RELIABLE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VENEZUELA REAL ESTATE, ITS OWNERS, OPERATORS, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR:

• ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES
• LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES

THIS LIMITATION APPLIES REGARDLESS OF THE LEGAL THEORY (CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE), EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU HAVE PAID TO US IN SUBSCRIPTION FEES DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless Venezuela Real Estate, its owners, operators, affiliates, officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

• Your use of the Service
• Any property transaction you enter into
• Your violation of these Terms
• Your violation of any rights of third parties
• Any dispute between you and any seller, agent, or other third party

13. Third-Party Links and Content

The Service may contain links to third-party websites or content. We are not responsible for the availability, accuracy, or content of these external resources. Your use of third-party sites is at your own risk and subject to their respective terms and policies.

14. Modifications to Service and Terms

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time without notice. We may also modify these Terms at any time by posting the updated version on our website.

Material changes will be indicated by updating the "Last updated" date. Your continued use after changes constitutes acceptance of the modified Terms.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration, except where prohibited by law.

You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.
